Our staff The majority of our Conveyancers are Solicitors or Legal Executives, and all of our support staff have several years' practical experience in handling property matters. As a result, you can be confident that all of your legal work will be dealt with by someone who knows exactly what is needed and how to achieve it. We know that moving house can be a stressful and emotional time, as well as being one of the most important financial transactions in your life. We will handle the conveyancing carefully and efficiently, but we will also provide you with a friendly service which is second to none. So what exactly does it involve? Conveyancing is just the name for the legal process by which your Conveyancer ensures that a property or plot of land is properly transferred to the new owner. The actual work involved varies from case to case. Each property - like each client - is different and has its own special requirements, but in each case it is the Conveyancer's job to ensure that the matter proceeds as smoothly and quickly as possible. If you are selling a property: - we will check through the deeds and prepare the contract for sale.
- we will (with your assistance) deal with any enquiries raised by the buyer's solicitors.
- we will explain the effect and implications of the contract to you before you sign it.
- if everything is in order we will exchange contracts and fix a completion date to suit you.
- on completion, we will transfer the deeds to the Buyer's solicitors and repay any existing mortgages using the proceeds of sale.
If you are buying a property: - we will check through the contract for sale to make sure that you will acquire all of the land which you are hoping to buy, and that you get any rights which are necessary to enjoy it.
- we will send any necessary enquiries to the seller's solicitors, and scrutinise their replies.
- we will carry out all necessary local, mining, drainage and environmental searches, to ensure that the property is not affected by any environmental issues, or any other matters or plans which might deter you from buying it.
- we will check through your mortgage offer and ensure that the money will be available when you need it.
- we will provide you with a detailed written report on the property before you commit yourself .
- we will explain the effect and implications of the contract and any mortgage deeds to you before you sign them.
- if everything is in order we will exchange contracts and fix a completion date to suit you.
- we will prepare the transfer deed and any mortgage documents.
- we will obtain the mortgage advance from your lender.
- on completion, we will transfer the funds to the sellers solicitors
- after completion we will pay any stamp duty land tax which may be necessary, and will arrange for your purchase to be registered at HM Land Registry.
If you are remortgaging a property: - we will check through the title deeds to ensure that all is in order.
- we will check through your mortgage offer and ensure that it is correct and that its terms are acceptable to you.
- we will carry out all of the searches required by your lender.
- we will prepare the mortgage deeds.
- we will explain the effect and implications of the mortgage deeds to you before you commit yourself.
- if everything is in order we will obtain the mortgage advance from your lender.
- on completion, we will repay any existing loans and account to you for any balance due to you.
- asfter completion we will arrange for the mortgage to be registered at HM Land Registry.
Fees & Charges Sales Our charges start at £375.00, plus VAT and out-of-pocket expenses (known as disbursements). For most properties, the only disbursement will be the cost of obtaining a "Register View", which is around £10.00. Purchases Our charges start at £450.00, plus VAT and disbursements. You are likely to incur the following disbursements: - Local Search - around £135.00 (depending on the location of the property)
- Mining Search - £23.29
- Envirosearch - £34.08
- Drainage search - £42.00
- Land Registry Search - £4.00
- Land Charges Searches - £1.00 per buyer
- Company Search - around £10.00 (only necessary if a company is involved)
- Land Registry Fee - between £40.00 and £700.00 (depending on the price paid).
- Stamp Duty Land Tax - if you are paying over £175,000.00 and the property is not in an exempt area, the Tax will be between 1% and 4% of the price, depending on the price paid.
Remortgages Prices start at £300.00 plus VAT and disbursements A remortgage involves basically the same disbursements as a purchase, apart from Stamp Duty Land Tax. Land Registry fees are based on the amount of the loan. Disbursements Disbursements are mainly to government departments, and are subject to change by those departments without notice. We will normally ask you to pay these expenses as they arise. Estimates We will always give any client a detailed written estimate of the costs likely to be involved in any conveyancing transaction. This is on the understanding that if, for any unforeseen reason, the transaction proves to be substantially more complex than could have been anticipated, we will notify you of any likely increase in costs.
