£5,000 for High Street Trip

A man who tripped on a raised paving stone in the pedestrian area of a high street has won £5,000 in compensation for his injuries.

The area was paved with small granite blocks, one of which was standing proud of the others. The man tripped over it and injured his leg, hand and wrist. He was found to have a fractured knuckle and required hospital treatment.

As a result of the accident, the man was unable to perform his usual work and had to be given light duties for two months while he recovered. He still experiences discomfort in his hand from time to time.

A personal injury claim was brought against the local council responsible for the upkeep of the pavement. The council admitted liability for the man’s injuries and offered a small sum in compensation.

The initial offer was rejected as not being commensurate with the man’s injuries and court proceedings were commenced. The council then revised its offer and an out-of-court settlement was reached. The paving stone that was the cause of the accident has now been repaired.
