We can help you to recover an unpaid debt from an individual or a business.

All the work we undertake on your behalf will be carried out by members of our experienced Dispute Resolution Department who will assist you throughout the process.

The usual stages in the debt recovery process include:

  1. Sending a letter of claim;
  2. Issuing proceedings;
  3. Entering Judgment;
  4. Enforcement.

If the debt is undisputed, we can offer a fixed fee for stages 1 to 3 above, and agree a competitive fee estimate in respect of the final stage.

If the debt is disputed, we can still assist with all of the above stages and are happy to agree a competitive fee estimate with you.

Some of the above costs may be claimed from the debtor and we can advise you how much you may claim depending on the circumstances of your case.

If the case is complex or the documentation provided is not in good order, it may take the matter outside of the scope of our fixed fee service. Any additional work and related cost will be discussed with you at the relevant time.

Our Services Include

  • Taking your instructions and reviewing documentation.
  • Sending a letter of claim.
  • Receiving any response and sending it to you;
  • If the debt is not paid, drafting and issuing proceedings.
  • Where no formal response is received to the claim, applying to enter Judgement in default and forwarding it to you.

Statutory Demand

In some cases, we may recommend serving a Statutory Demand on the debtor as an alternative to issuing proceedings. Our usual charge for this is £500 plus VAT. A process server fee of approximately £100 plus VAT may also be chargeable depending on your case. If the debt is still not satisfied then you may wish to issue a petition against the debtor. Our related work is charged on a time spent basis at the rates below and we will agree a fee estimate with you.

Our services include taking your instructions, reviewing the documentation, drafting the statutory demand and arranging service, and receiving any response and sending it to you.

Enforcement

If you do issue proceedings and obtain a Judgment in your favour, there are a number of ways that you can seek to enforce it against the debtor, including by way of a:

  • Warrant of Control;
  • Writ of Control;
  • Charging Order;
  • Third Party Debt Order;
  • Attachment of Earnings Order;
  • Statutory Demand;
  • Bankruptcy Petition / Winding Up Petition;

We will be happy to explain which of the above options would be the most suitable for your particular case and agree an estimate of costs for our related work.

Costs - Disputed Debt Recovery

Where the debt is disputed, or becomes disputed, our fees will be charged on a time spent basis. We will be happy to agree an estimate for our related work based on the specific circumstances of your case.

Timescale

Undisputed debt recovery cases may take between 4 and 16 weeks to be resolved up to Judgment or sooner payment. However, this depends on how promptly the debtor responds and / or the Court deals with your case. If enforcement action is required, the case may take longer to resolve. Disputed debt recovery cases may take significantly longer and we can provide you with a related timescale estimate depending on the circumstances of your case.
